Demox respects copyright. Here is how to tell us about an infringement, and what happens next.
Sending a notice
If you believe content on demox.world infringes your copyright, send a notice to our designated agent: Tom Spark, legal@tomsparkbox.com (subject line “DMCA notice”). A postal address for the agent is available on request at the same address and is listed in our U.S. Copyright Office designated-agent registration.
A complete notice under 17 U.S.C. §512(c)(3) includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you say is infringed.
- The URL of each post, comment or image you want removed.
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorised to act for them.
Incomplete notices are answered with what is missing; they do not start the clock.
What we do
On a valid notice we remove or disable access to the identified material promptly, record the action in the public moderation logwith the reason “copyright” (the notice itself is not published), and notify the account that posted it.
Counter-notices
If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notice under 17 U.S.C. §512(g) to the same address. It must include your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification, your name, address and telephone number, and consent to the jurisdiction of the federal court for your district (or, outside the U.S., any judicial district where Demox may be found). We forward counter-notices to the original complainant; unless they tell us within 10 business days that they have filed a court action, we may restore the material in 10 to 14 business days.
Repeat infringers
An account that receives three valid notices within twelve months is terminated. Deliberate, repeated infringement can be grounds for termination sooner.
Misuse
Knowingly false notices and counter-notices carry liability under 17 U.S.C. §512(f). Please only send a notice for material you actually own or are authorised to act on.
